MARCUSSTROMAN FOUNDATION BASEBALL CLINIC

The Marcus Stroman HDMH Foundation (the “Foundation”) is organizing a baseball clinic at 13 Morris Avenue, Glen Cove, NY 11542 (the “Clinic”) on July 22, 2021(rain date: August 9, 2021).

Your participation in or attendance at the Clinic automatically begins the Assumption of the Risk and Waiver of Liability set forth herein.

Assumption of the Risk and Waiver of Liability Relatingto Coronavirus/COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, the Center for Disease Control (CDC) recommends social distancing and wearing masks when you are not outside by yourself or with members of your household. The Foundation recommends that all Clinic participants/attendees follow the CDC recommendations. However, the Foundation cannot guarantee that you or your children will not become infected with COVID-19, even if you follow the CDC guidelines. Further, attending the Clinic could increase your risk of contracting COVID-19. By being present at the Clinic, whether as a participant, volunteer or attendee, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk of me or my children (if applicable) being exposed to or infected by COVID-19, I understand that the risk of becoming exposed to or infected by COVID-19 at the Clinic may result from the actions, omissions, or negligence of other attendees, or others, including, but not limited to, Marcus Stroman, the individual, the Foundation, its employees, volunteers or agents, and other Clinic participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection our presence at the Clinic (“Claims”). On my behalf, and on behalf of my children, if applicable, I hereby release, covenant not to sue, discharge, and hold harmless Marcus Stroman, the individual, the Marcus Stroman HDMH Foundation, which is organizing the Clinic, as well as its employees, volunteers, and agents, of and from any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Marcus Stroman, the individual, the Marcus Stroman HDMH Foundation, its employees, volunteers and agents, whether a COVID-19 infection occurs before, during, or after my presence at the Clinic.
